Terms of Service Agreement

Please read these Terms of Service carefully. By accessing or using Drive Smart Driving School websites, online course portals, class registration pages, road-test scheduling pages, forms, payment links, or related services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use our websites or services.

1. Agreement to These Terms

These Terms of Service are a legally binding agreement between you and Drive Smart Driving School (“Drive Smart,” “we,” “our,” or “us”) regarding your use of our websites, course portals, enrollment services, scheduling tools, payment pages, classroom services, Zoom services, road-test services, behind-the-wheel instruction, and related services.

Drive Smart Driving School operates under Texas Department of Licensing and Regulation (“TDLR”) licensing, including Drive Smart Driving School C2830 and Drive Smart Driving School C2830A, as applicable.

These Terms apply to all visitors, students, parents, guardians, account users, purchasers, and anyone using Drive Smart websites or services.

2. Websites and Services Covered

These Terms apply to Drive Smart websites and related services, including but not limited to:

  • drivingschoolcarrollton.com
  • drivesmartdfw.com
  • drivesmartdrivingschooltx.com
  • Any other website, course portal, registration page, scheduling page, form, or payment page operated by Drive Smart Driving School

Our services may include teen driver education, adult 6-hour driver education, online courses, Zoom classes, in-person classes, behind-the-wheel instruction, road-test scheduling, third-party road testing, student record processing, certificate processing, payment processing, and related support services.

3. Relationship to Enrollment Agreements and Course Policies

These Terms are general website and service terms. Some Drive Smart programs may also require a separate enrollment agreement, registration form, course agreement, refund policy, road-test policy, parent/guardian acknowledgement, or student acknowledgement.

If there is a conflict between these Terms and a specific signed enrollment agreement, course agreement, road-test policy, refund policy, or other written service-specific policy, the more specific document will control for that service.

4. Eligibility and Minors

Some Drive Smart services are intended for teen students under the age of 18. A parent or legal guardian may be required to enroll the student, sign required agreements, provide consent, make payment, communicate with Drive Smart, and participate in required licensing steps.

If you are under 18, you may use Drive Smart services only with the involvement and consent of a parent or legal guardian where required. Parents and guardians are responsible for the accuracy of student information they provide and for helping the student comply with course, licensing, attendance, and safety requirements.

5. Account Registration and Student Information

Some services require an account, student profile, registration form, or course enrollment record. You agree to provide accurate, complete, and current information, including student name, date of birth, contact information, parent/guardian information where required, course selection, and any other information needed for enrollment, identity verification, course records, scheduling, compliance, or certificate processing.

Providing false, incomplete, misleading, or intentionally inaccurate information may result in delayed service, denied access, cancellation, suspension, termination, inability to issue course records or certificates, or other action permitted by law and Drive Smart policy.

6. Account Security

You are responsible for keeping your username, password, authentication codes, and account access secure. Do not share your course login, account, password, authentication code, or student access with another person.

Notify Drive Smart promptly if you believe your account has been accessed without authorization. Drive Smart is not responsible for losses, delays, course issues, record issues, or account problems caused by a user’s failure to protect account access.

7. Online Course, Identity, and Compliance Rules

Students using online courses, course portals, timers, quizzes, exams, video gates, identity verification, multifactor authentication, or other course systems must complete the course honestly and personally.

You agree not to:

  • Share course access with another person
  • Allow someone else to complete coursework, quizzes, exams, videos, identity steps, or attendance steps for the student
  • Attempt to bypass timers, video requirements, identity checks, lesson locks, course gates, quizzes, exams, or completion requirements
  • Use false identity information or false student records
  • Manipulate the website, browser, local storage, system time, code, or course platform to create false completion records
  • Copy, sell, distribute, or misuse course content
  • Interfere with any security, compliance, identity, payment, or student record system

Violation of these rules may result in removal from the course, loss of access, denial of completion, refusal to issue records or certificates, and any other action permitted by law, TDLR rules, DPS requirements, or Drive Smart policy.

8. Course Completion, Certificates, and Licensing Requirements

Drive Smart may provide course completion records, certificates, or other documentation when the student has completed all applicable course, attendance, testing, payment, identity, and compliance requirements.

Drive Smart does not guarantee that a student will pass a permit test, final exam, road test, DPS review, or licensing process. Texas driver licensing requirements are controlled by state law, TDLR rules, DPS rules, and other applicable agencies.

Students and parents are responsible for ensuring they have the correct documents for DPS, learner license issuance, driver license issuance, Impact Texas Drivers requirements, school enrollment verification, road testing, and any other required steps.

9. In-Person Classes, Zoom Classes, and Attendance

Students attending in-person or Zoom classes are responsible for arriving on time, participating appropriately, and following class instructions. Attendance, participation, identity verification, and completion requirements may apply.

For Zoom classes, students are responsible for having a working internet connection, device, camera, microphone, and access to any required materials or links. Drive Smart is not responsible for a student’s failure to attend or participate due to device issues, internet problems, incorrect email addresses, missed links, or failure to follow instructions.

10. Behind-the-Wheel Instruction

Behind-the-wheel instruction is subject to scheduling availability, instructor availability, student eligibility, weather, vehicle availability, safety considerations, required documentation, and applicable law or agency rules.

Drive Smart may refuse, reschedule, or stop a driving lesson if a student is unsafe, unprepared, impaired, disruptive, not properly documented, not eligible to drive, or otherwise unable to participate safely.

11. Road Tests

Road tests are separate from driver education courses unless specifically stated in a package or written agreement. Road-test eligibility depends on the student’s age, permit/license status, required course completion, Impact Texas Drivers completion, required documents, vehicle requirements, payment status, and applicable DPS or state rules.

Drive Smart does not guarantee that a student will pass the road test. The student must demonstrate safe and legal driving skills during the test. Road-test fees, rescheduling, cancellation, no-show, vehicle-use, and document-upload policies are controlled by the road-test booking page and applicable Drive Smart policies.

12. Payments, PayPal, and Third-Party Payment Processors

Drive Smart may accept payments online through PayPal, credit/debit card processors, WooCommerce, or other third-party payment services. By making a payment, you agree to the payment terms shown at checkout or on the applicable enrollment or booking page.

Drive Smart does not control PayPal, banks, card networks, or third-party payment processors. Their terms, privacy policies, fraud checks, payment holds, disputes, chargebacks, and processing rules may also apply.

Course access, class placement, road-test scheduling, behind-the-wheel scheduling, or certificate processing may be delayed or denied if payment is incomplete, failed, disputed, reversed, refunded, or suspected of fraud.

13. Refunds, Cancellations, Transfers, and Rescheduling

Refunds, cancellations, transfers, substitutions, missed classes, missed lessons, missed road tests, late arrivals, and rescheduling are governed by the specific enrollment agreement, course policy, road-test policy, checkout terms, or booking terms that apply to the service purchased.

Some services may become non-refundable once course access is granted, instruction begins, a seat is reserved, a road-test appointment is booked, a vehicle is reserved, or administrative processing has started. Review the specific terms presented during enrollment or scheduling.

14. User Conduct

You agree to use Drive Smart websites and services lawfully and respectfully. You may not use our services to:

  • Harass, threaten, abuse, or impersonate another person
  • Submit false, misleading, defamatory, or unlawful information
  • Interfere with website security, course systems, payment systems, or scheduling systems
  • Upload malware, viruses, spam, or harmful code
  • Attempt unauthorized access to student records, staff systems, payment systems, course content, or administrative systems
  • Use Drive Smart content or systems for unauthorized commercial purposes

Drive Smart may limit, suspend, or terminate access for conduct that violates these Terms, course policies, safety expectations, payment requirements, or applicable law.

15. User Content and Submitted Information

You may submit information through forms, course systems, email, uploads, checkout fields, enrollment documents, or other tools. You retain ownership of information you submit, but you grant Drive Smart permission to use it as needed to provide services, maintain records, process enrollment, verify identity, comply with legal and regulatory requirements, communicate with you, and support course, lesson, certificate, or road-test administration.

You are responsible for ensuring that information you submit is accurate and that you have the legal right to provide it.

16. Feedback and Suggestions

If you submit ideas, suggestions, comments, corrections, or feedback to Drive Smart, you agree that Drive Smart may use that feedback without compensation or obligation to you.

17. Website Content and Intellectual Property

Drive Smart website content, course content, graphics, videos, forms, lesson materials, policies, software, logos, page designs, and other materials are owned by or licensed to Drive Smart and are protected by copyright, trademark, and other laws.

You may not copy, reproduce, sell, publish, distribute, modify, reverse engineer, scrape, or commercially exploit Drive Smart content, systems, or course materials without written permission.

18. Third-Party Links and Services

Our websites may link to third-party websites or services, including payment processors, forms, video platforms, maps, scheduling tools, government websites, DPS resources, TDLR resources, or related service providers.

Drive Smart is not responsible for third-party websites, third-party content, third-party policies, third-party outages, or transactions completed outside Drive Smart systems.

19. Service Availability and Changes

Drive Smart may update, revise, suspend, discontinue, or change websites, courses, schedules, prices, payment options, policies, links, class formats, or services at any time, subject to applicable law and any specific signed agreement.

We try to keep our websites and course systems available, but we do not guarantee uninterrupted access. Technical issues, maintenance, internet problems, hosting issues, third-party outages, user device issues, or other events may affect access.

20. No Guarantee of Results

Drive Smart provides driver education, instruction, testing services, scheduling assistance, and related support. We do not guarantee that a student will obtain a learner license, driver license, pass an exam, pass a road test, receive DPS approval, or qualify for a specific state result.

21. Disclaimer of Warranties

To the maximum extent allowed by law, Drive Smart websites and services are provided “as is” and “as available.” Drive Smart disclaims warranties of any kind, whether express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and uninterrupted access.

22. Limitation of Liability

To the maximum extent allowed by law, Drive Smart is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our websites or services.

This limitation applies to issues including, but not limited to, website outages, course access problems, missed appointments, scheduling delays, third-party payment issues, user device problems, incorrect user information, or licensing outcomes controlled by state agencies.

23. Indemnification

You agree to defend, indemnify, and hold harmless Drive Smart Driving School, its owners, employees, contractors, instructors, examiners, agents, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of our services, your violation of these Terms, your submitted content, your false or inaccurate information, your misuse of course systems, or your violation of law.

24. Termination or Suspension

Drive Smart may suspend or terminate access to websites, accounts, courses, scheduling tools, records, or services when necessary due to nonpayment, suspected fraud, safety concerns, inaccurate information, policy violations, misuse of systems, legal requirements, regulatory requirements, or violations of these Terms.

25. Privacy

Use of Drive Smart websites and services may involve collection and use of personal information. Please review our Privacy Policy for information about how personal information is collected, used, and protected.

26. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or Drive Smart services shall be handled in the appropriate state or federal courts located in Texas, unless another venue is required by law or by a specific written agreement.

27. Changes to These Terms

Drive Smart may update these Terms from time to time. The “Last Updated” date will show the most recent revision. Continued use of our websites or services after changes are posted means you accept the updated Terms.

28. Miscellaneous

  • If any part of these Terms is found unenforceable, the remaining parts remain in effect.
  • Failure to enforce a provision does not waive our right to enforce it later.
  • You may not assign or transfer your account, course access, appointment, or rights under these Terms without Drive Smart’s permission.
  • Headings are for convenience only and do not limit the meaning of the Terms.
